Wetland/Water Restrictions

This property has been identified as Emerging Wetlands and Groundwater-Fed Springs Wetlands

according to the U.S. Fish and Wildlife Service.

The springs on the site, which were improperly capped by "Lee Investments Group,"

were capped in violation of the Utah Clean Water Act.

This action has also resulted in a breach of the Migratory Bird Treaty Act,

as it caused the unnecessary displacement and, in many cases, the death of

protected migratory species.

Furthermore, this action violates the Endangered Species Act (ESA) due to the

presence of federally protected and endangered species on the property, including:

A mating pair of California Condors (a critically endangered species)

Woodpeckers (protected under the MBTA)

Barn Owls

Mallards

Migrating Geese

Various species of Hawks.

These violations have had a significant impact on the local wildlife, particularly

species that rely on the wetlands and springs for survival.

Immediate remediation and restoration efforts are necessary to comply with federal and state environmental laws and protection of the remaining habitats.

Further development and rezoning would serve to provoke

additional violations of these existing laws and regulations.
